Our Chapter 13 Bankruptcy Practice
If you fail to qualify for the discharge of debts under Chapter 7, or if you want to avoid foreclosure and keep real property, or if you simply prefer to repay your creditors, we can help you stop the harassing phone calls and letters, and even stop home foreclosure proceedings, through a Chapter 13 bankruptcy filing. We will handle all matters related to your Chapter 13 petition, preparing and submitting all documents required during the process, and acting as your advocate in all meetings with creditors, the bankruptcy trustee or the court.
In a Chapter 13 filing, you enter into an agreement to repay your creditors over a 3 to 5 year period. When you file for protection under Chapter 13, you will immediately be protected by the law's automatic stay, which prohibits creditors from calling, writing or making any other attempt to collect the debt from you. You must uphold your part of the agreement, however, or you will lose the protections of the bankruptcy law.
Because non-judicial foreclosure sales are common in Alaska, we often help clients forestall foreclosure through a Chapter 13 reorganization of debt. If you have an arrearage, we can help you incorporate that amount into a repayment plan to bring your mortgage current.
