Our Chapter 7 Bankruptcy Practice
In a Chapter 7 bankruptcy proceeding, you are allowed to permanently discharge certain debts in exchange for your agreement to sell non-exempt assets. When you file for protection under Chapter 7, your creditors must immediately stop all attempts (outside of the bankruptcy proceeding) to collect the debt from you.
Under the recent revisions to the bankruptcy law, you must now qualify to file under Chapter 7. We will walk you through the "means test" set up under the new law to determine whether you are eligible. If so, we will prepare and file all the documents required to take you through the bankruptcy process. We will also represent you in hearings or meetings with creditors, the bankruptcy trustee or the court.
If you are considering a Chapter 7 petition, we will carefully explain the debts that can and cannot be discharged, so that you know what to expect before you file. We will also monitor the bankruptcy sale to ensure that exempt assets are excluded. Attorney Cahill can help you determine which exemptions best apply in your situation.
Contrary to popular belief, you can rebuild your credit after bankruptcy. We can help you start the process as soon as two months after the completion of your bankruptcy.
